Liss & Marion is proud to announce a $900,000 settlement on behalf of a client who suffered a fractured cervical vertebra in an intersectional collision involving a tow truck that ran a red light. The case presented unique challenges due to disputed liability between the tow truck driver and the client’s host driver, who was uninsured at the time of the crash.
The accident occurred when the client was a passenger in a vehicle proceeding through an intersection. A tow truck entered against a red light, striking the vehicle with significant force. The impact resulted in a severe neck injury, requiring surgery and extensive rehabilitation. After months of intense investigation, depositions, a research, Liss & Marion was able to prove that the tow truck driver was unlicensed at the time of the crash and was speeding through the intersection. Despite ongoing disputes over fault between the drivers, Liss & Marion aggressively pursued justice for the innocent passenger, with the insurance company for the tow truck driver eventually folding and ultimately securing a substantial settlement.
“Our client had no control over what happened but endured the most serious consequences,” said Adam Gilberg, lead attorney on the case. “With liability being contested and the host driver lacking insurance, this case had significant legal hurdles. However, through diligent investigation and strategic advocacy, we ensured our client was compensated for their pain, suffering, medical expenses, and long-term care needs. This settlement does not heal his injuries, but it will set our client up for a stable future, despite his physical limitations from the injuries.”
Motor vehicle accidents like this can totally re-shape someone’s life. Trucking accidents can cause some of the most severe injuries, but can also create some of the most difficult hurdles in litigation. Our client was a young man, in his mid-twenties, just preparing to enter the working world and be an active productive member of society. This accident not only changed his life, but his entire family’s lives, as they came together to support our client. We were honored to be welcomed into our client’s life, his family, and to be there to support him in his quest to recover from this brutal injury. This case highlights Liss & Marion’s dedication to fighting for injury victims, even in complex disputes involving uninsured drivers and contested liability.
